Howdy there, Scream Freaks! While you’ve been enjoyin’ animated bloodshed between your 2 favorite indie film companies, there’s been struggles of other sorts behind the scenes. When we first imagined Troma vs Full Moon, we thought it would be amazin’ to get the actual companies involved. No deals, obligations or contracts – just good ol’ fashion fun that gives somethin’ back to the filmmakers who entertained us for so many years.
The pitch was simple enough. Our show humorously parodies their characters in a ridiculous feud, and we review Full Moon and Troma movies we think horror/sci-fi fans need to know about. All covered under Fair Use which legally allows such works to exist like South Park and Robot Chicken. Because Troma vs Full Moon is meant to be a gift for everyone in the horror community to enjoy, we didn’t want any profit off these videos and even went as far as tellin’ Full Moon and Troma they could have the episodes to monetize on their own YouTube channels and streamin’ services. We even shared the full rundown for the season and made adjustments upon request to best promote each company respectively and any films they have comin’ up.
Needless to say, Full Moon loved the idea and recognized it for the win win situation it provided with opportunities for cross promotions, a chance to hype up their internet presence, and see its characters animated. Troma, on the other hand, wasn’t as enthusiastic and ultimately chose to not participate in the end. After several attempts to plead our case for this being a non-profit parody review produced by long time fans who have nothin’ but respect for their material and would only promote their films, we are unfortunately forced to cut Troma out of this fantasy fight.
What does this mean for this season? We’re still movin’ forward with Full Moon’s participation, but will be censorin’ everythin’ to do with Troma, minus the reviews of their movies. At this point, it’s our honest belief the power to turn this whole thing around resides with you Scream Freaks. We can’t explain or understand why Troma of all companies would want to put the brakes on something as independent as this endeavor of love, but maybe your voice can be enough to convince them otherwise.
Email ’em, tweet ’em, Facebook messege ’em, reach Troma however you can and let them know how badly you want to see this season in its full animated glory. And maybe, just maybe, they’ll finally understand there’s no harm in any of this and give us the green light to run free with it.
We respect Troma’s wishes in the meantime, continue to enjoy their films, and don’t harbor any ugly feelin’s over this matter. In all this confusion, however, we can’t help but come back to things Lloyd Kaufman’s written in the past:

I know I like some of your movies like toxic avenger but please let the people of screaming soup continue to present your characters on their show they are not hurting or making fun of anyone like they both characters from both troma and fullmoon are presented in a parody manner and impersonated by southners at the beginning of each episode.So please lighten up and let us see your characters like he said they are not like south park or other shows that poke fun just because they can, the people of screaming soup are in for the fun to give back to the fans of both Troma and Fullmoon. If they are upset about the paperbag puppet of Lloyd Kaufman like you said Kaufman was busy with other projects right to appear on the show so they decide to do a parody with a puppet of him at the last minute.So please let screaming soup still continue with this season with no problems.

Hi again I see you gone all censer crazy there and they on the 2 episodes are not about boobs.I know you told everyone out there to state their freedom of speech to Troma about this heartbreaking ordeal,but I also got a idea if you already didn’t do it yet how about you talk to the other horror reviewers on Youtube like Horror Guru, Count Jackula, Bloodbath and Beyond, Horror Addicts, Brandon Tenold, Final Answers Grim Reaper, The Ghouligans just to name a few to help spread the word to the other horror fan out there and give their best for support.Let me know if it’s a good idea or already thought about that.And I hope we have good news soon.

If that wasn’t clear enough: Enough people will have to willfully use their copyright and trademarks in a fair use manner regardless of their wishes as a means of making a statement/protesting against their way of thinking. It doesn’t matter what these people who use their copyright do as long as it qualifies as fair use.
As for me though, I’m simply not invested enough in this media, which is why I have resorted to giving you this advice instead.

It should probably be noted BTW that as per the First Amendment, the DMCA as federal law can not legally be used to stifle free speech and the use of the copyrights and trademarks would not be wilful infringement but protest, which I’m pretty sure falls under the First Amendment’s Right to Peaceful Assembly.section, even if said protest is done digtially.

We hear you loud and clear and have done a lot of reading on parody and free speech pertaining to Fair Use. Ultimately, we’re worried if push came to shove, Troma could easily hit the channel with copyright strikes (which they think we’re violating despite obvious disclaimers and paperbag dopplegangers). After watching a video the Nostalgia Critic posted about how poorly YouTube handles such unfounded disputes with soulless automations that leave channels hindered and incapacitated at times, we didn’t want to risk the headache. And then there’s the fact anyone can sue you for anything, even if you’re in the right. We don’t have the time, money, or care to go to court with people who have done so with New Line Cinemas and other filmmakers they felt cheated them in the past. As long as the Scream Freaks can still enjoy these episodes and tolerate our need to see this crossover through, we’ll be past this season in no time and on to uncensored pastures. Luckily, future episodes will be a little Full Moon heavy so there won’t be quite as much censored. Thanks for the support and advice!

There are other outlets besides YouTube, though even if they were noticed, other websites have an obligation to uphold DMCA claims if they want to protect their safe harbor. Of course, they really wouldn’t have to worry if the claimed works were ultimate deemed fair use in court. YouTube is simply too lazy and cowardly to want to have to put up with that kind of thing and/or Google cares way too much about getting all that precious extra ad revenue like the greedy misers they are.
That said, there’s no real safe haven for fair use, especially to those who don’t understand what doesn’t count as fair use and sadly, there are a LOT of them out there.
